RENTAL AGREEMENT AND CONDITIONS

SEASIDE CAR RENTAL - RENTAL AGREEMENT


1. PARTIES AND SCOPE OF THE AGREEMENT

This agreement is made between Seaside Car Rental (hereinafter referred to as "Lessor") and the customer renting the vehicle (hereinafter referred to as "Lessee") to define the terms and conditions of the car rental service.


2. RENTAL CONDITIONS

Age and Driver's License Requirements:

  • Economy Group Vehicles: Minimum age of 21 and at least 2 years of a valid driver's license are required.
  • Mid-Group Vehicles: Minimum age of 23 and at least 2 years of a valid driver's license are required.
  • Upper and Luxury Group Vehicles: Minimum age of 27 and at least 2 years of a valid driver's license are required.

Credit Card and Deposit:

  • The Lessee must have a credit card issued in their name and open for online transactions.
  • The financial status of the Lessee may be evaluated through findeks.com if necessary. If deemed unsuitable, the rental process will not proceed.
  • As an alternative to a credit card, a cash deposit of 850 Euros or a provision option may be offered.

3. RESERVATION AND PAYMENT CONDITIONS

  • The payment made during the reservation must match the credit card used at the time of signing the agreement.
  • For prepaid reservations, the credit card used for payment must be presented at the time of delivery.

4. VEHICLE DELIVERY AND RETURN

  • The vehicle must be picked up and returned at the date and time specified in the agreement.

Delivery and Return Restrictions:

  • The vehicle cannot be returned to a location or district other than the one from which it was rented.
  • A 1-hour waiting period is granted during returns. If this period is exceeded, an additional fee will be charged.
  • No refunds are provided for early vehicle returns.

Late Returns:

  • For late returns, a fee equivalent to 1/5 of the daily rate will be charged per hour. If the delay exceeds 5 hours, a full day’s fee will apply.

5. INSURANCE AND COVERAGE

  • All vehicles are insured under the rental terms.

Conditions for Insurance Validity:

  • Compliance with traffic laws is mandatory.
  • Damages caused under the influence of alcohol or drugs are not covered by insurance or the Lessor.
  • Vehicles must only be used on public roads and in accordance with legal regulations.

Scope of Insurance:

  • Collision Damage Waiver (CDW) is included in all rentals.
  • For collision-related damages, the Lessee is liable for an amount up to the vehicle group's deductible (approximately 800 Euros).
  • Exclusions: Non-collision damages (parking lot damage, tires, windows, headlights) are not covered by insurance.
  • Theft, loss of keys, or loss of personal belongings left inside the vehicle are not covered by the insurance.


6. FUEL POLICY

  • The vehicle must be returned with the same fuel level as when it was picked up.
  • Additional fees will be charged for missing fuel.

7. ADDITIONAL DRIVERS

  • Additional drivers can be included in the agreement with the Lessor's approval and for an extra fee.
  • Additional drivers must also meet the age and license requirements.

8. USAGE RESTRICTIONS

  • The vehicle may only be used in the countries specified in the agreement.
  • Written approval from the Lessor is required for international travel, and additional fees may apply.

9. CANCELLATION AND MODIFICATION CONDITIONS

  • Reservation cancellations are processed as per the following conditions:
    • Cancellations made 24 hours prior to the rental period: Free of charge, and payments are refunded within 7 business days.
    • Cancellations made less than 24 hours before the rental period:
      • If the full rental payment was made, 90% will be refunded.
      • If only a partial payment was made, no refunds will be issued.

10. TOLL PASSAGES AND TRAFFIC FINES

  • Traffic fines, tolls, and bridge passage fees are the sole responsibility of the Lessee.
  • If the vehicle is impounded by legal authorities, the rental duration continues to accrue fees.

11. IMPORTANT NOTES

In Case of an Accident:

  • The vehicle must not be moved, and an accident and alcohol report must be obtained from the nearest police or gendarmerie station. Failure to do so will void the insurance coverage.
  • If the Lessee is found to be under the influence of alcohol or drugs, all financial and legal responsibility rests with the Lessee.

In Case of Theft:

  • The nearest police or gendarmerie station must be contacted, and the Lessor must be informed immediately.

12. MISCELLANEOUS PROVISIONS

  • The Lessee must carefully read the agreement before receiving the vehicle and clarify any points they do not understand with the Lessor.
  • Matters not mentioned in this agreement will be resolved in accordance with applicable legal regulations and the Lessor’s general policies.
